I have recently split with my partner after 5 years, we were not married, have 2 children and a mortgage that is solely in my name. I have worked throughout the relationship and been the only financial provider for the family.
She has not worked or contributed in any way. She chose to leave the house and take our 2 children to live on benefits in a council house. I have a feeling she is about to try to take a % of my house, is she entitled to any of it?Many couples choose to live together without getting married and this is often referred to as ‘common law marriage’. However, this term is not recognized by law and does not hold any of the same rights as a legal marriage, however long you have been together. Many people believe that they are entitled to a percentage of their partner’s assets but this is not true. This is good news for you!
If the mortgage is solely in your name and you did not have any formal cohabitation or rental agreement with your partner then she is not entitled to claim any of your house. You say that you have been the sole provider, but even if your partner had been making financial contributions, unless her name is on the deeds, it’s all yours. She may still try to make a claim but the law is on your side and she is unlikely to have a case.
Having said that, you have two children together and you need to think about their welfare too. You will have to, by law, pay child maintenance to your partner but you may want to think about what else you could contribute to make your children’s lives better. It is understandable that you will feel angry towards your partner, and she has made her own choices, but this should not impact on your children’s lives.
Try to remain as civil as possible with their mother and come to an arrangement about custody and child support. If you cannot work this out together then there are a lot of liaison services available that will help you or you can take it through the courts.
You may also want to think about making a will so that your children are guaranteed to inherit your property if anything may happen to you. You can state that they don’t receive any of it until a certain age, or assign a executor so that your ex-partner doesn’t try to get hold of it.
Whatever you decide to do, your home is all yours but make sure that your children remain your priority and that they are protected, both financially and emotionally.

He became very ill in April this year died in August, he never made a will, his son registered his death went to probate only to be told I was still on the deeds and have inherited his house. I phoned the company dealing with my divorce they said they didn’t send the financial agreement to court as they sent it back to me electronically to amend a typo and I failed to press the submit button so they never got it back or thought to contact me, I never even knew it had been sent back as I never got an email or phone call and had no reason to contact them, I assumed they were dealing with it and due to covid and lockdown i presumed there would be a delay.
Anyway what do I do now, I don’t want the house,we were joint proprietors which is why it’s now mine, his kids get nothing, the land registery won’t amend this in retrospect as he has died even though I can show them the intention was there for me to give him the whole property but due to circumstances this didn’t happen, they say gift it to his children but then there are capital gains tax implications where as if they inherited it there would be no tax to pay,they want to live in it, I could sell it and give them the money but I will be taxed as I own another house and they would pay capital gains I just don’t know what to do,

During our time I built an extension to the house which I paid for myself, but he did fit 2 mechanical locks on the back door and 1 in the garden room. He also took the responsibility of paying for the broadband as part of his mobile phone deal so one of the bills is in his name.
He has been in Guyana studying since April 8th and plans to return end August. If I let him back will he be seen as having rights to my house?

I’ve extensively updated the property and have paid the mortgage on my own since it was taken out in 2006. All of which I can prove.
During this period I paid for appliances, redecorated the entire house, developed and maintained the property to a high standard.
When i moved out of the property over 2 years ago, i took nothing with me and left her with everything.
She is now selling the house for a very healthy profit, but has not told me about this, including not having a 'for sale' sign at the property. This leads me to believe she thinks I may be entitled to a percentage of any house sale.
I would like to know if i am entitled to any percentage of the sale when it is sold, any advice would be greatly appreciated.

Next dilemma is his previous partner before me is named on his will in that in the event of his death, she is entitled to live at the property at the agreement of the oldest child (the 24 year old). Does this allow her any entitlement to the property?

Despite me becoming the main carer I will need to remain working fulll time as he will not be paying half of our current expenses meaning the financial burden on me will be higher. I have two main questions
- can I request that he pays at least half or more as I need to reduce at least to 4 days to meet their needs

We took out a JOINT loan of £25k for the wedding. I have said i will take care of the loan fully and i gave her £10,000 when she left. She is now claiming i owe her more.

I bought a house with my ex-partner in Jan 13. We had a child in Apr 13. The house and mortgage are both in my name only. We were engaged in May 15 but never married. Then she stopped me from seeing the children via video calls and didn't come to the UK and made some excuse she couldnt take time out work. Then said her brother would come so I paid the extra to transfer the ticket to his name and then he didnt come I lost £800 on that and havent seen my children. So I started a haig return order which then because of the consent I was advised it would be hard to then I went for contact order and after 8 hard months I worked two job to get enough money to pay off my debt some loans my credit cards. Both paid equal deposit of 2.5k for the house. Joint account opened just for mortgage and bills and have worked out that since Dec 15 ex has paid a total of 1.5k towards bills as was taking more money out the joint than paying in. The house was a full renovation which I used my inheritance from parents to do up the house. We also got a 5k loan to finish it but only spent 2.3k of it on the house. The remaining 2.5k he spent on himself. Gambling and drinking. We also have a kitchen and sofa on finance. Totalling just over 6k still to pay back.
So my question is.. I want to remain in the house and he will not discuss the house maturely he just says he wants what he's 'owed' what are my options? How can I get him off the mortgage without having to fork out thousands to buy him out when he has inputted so little??
The mortgage should have finished in 2013 but the last time I had chance to ask him 2016 he said it was still ongoing. He is living with someone else and has another mortgage in his name alone. I can't be certain, but I think he had taken out loans on the mortgage of my home to pay for cars, holidays and renovations on his own property. I have tried to ask but don't get a real response.

Some what sadly (sense of failure), I have recently split form my partner of 24 years, we were not married. She developed an alchohol problem which has gotten out of hand resulting in me asking her to move out (not happy). We have lived together for over 20 of those, firstly, in her solely owned "smaller" house, which she still owned and was rented ( and has now moved back into). Then for the last 19 years in our current "bigger" house, wholly owned by myself, with all the deposit, mortgage and bills paid by me. We have 2 children who have chosen to stay in the "big" house. I say children, the eldest is 19 and the youngest 18 in a few weeks although both in full time education. I have been the main bread winner but my ex has always worked although she took opportunity to make personal lifestyle work choices. My ex always treated her original home as her asset, taking money via an additional mortgage to start a business ( not the one referred to below), even though I was against. I have always saved and reduced my mortgage with on eye on needing to fund my daughters education, something my ex never concerned her self with. Hence, she has very little in personal savings. Whilst I was always willing to share assets when we were together, I feel given her lifestyle choices I shouldn't have to sell my home or hand over my savings, some which were also inherited and some from a 25 yr savings plan. On an equity front, there is little doubt my personal assets via pension and this house are far greater. But she does have her own home, albeit with a mortgage which she hasn't had to pay for the past 20 years. There is also small buisness we started together 8 years ago, start up funded by me and now she has 100% of the shares in her name for tax reasons. I have accepted she will take this over, as it is effectively her living now.
Can she have any claim on my house equity, pensions and savings? she keeps mentioning I need to settle with her, and a solicitor has said there would be implied trust, as I couldn't have paid the mortgage and saved if if wasn't for my ex working and helping with child care. This is a stretch of the true picture. The saving are not insignificant but a majority, around £50k, I have saved earmarking for my daughters education ( about 30k) and the rest as a start in life, I begrudge "robbing" the funds from my daughters pot, as there is only one who will replace it.
There is one other issue, about 4 years ago I helped my ex's mother out as none of her 4 children wanted to. She wanted to move to a bungalow and due to bank austerity measures and age she couldn't get the 20k she needed on a mortgage. I agreed to lend £20k of the earmarked children's education money, on the basis is wouldn't be required for a while. After a bit of advice. In November me & my gf split after 11 years together. We jointly own a house which we bought in 2013. We paid £185k for it & it's now worth £270k. Since 2013 my gf (who earns more) has been paying the mortgage, whilst I paid most of the rest (mortgage monthly was £530, I was paying £250 for everything else).
We initially bought the house thanks to substantial (£20k plus) deposit gift to myself from my parents. In the eventuality things do not remain cordial, and we can't sort it out acrimoniously, where would I stand? My gf has told me that one of her friends believes she's entitled to the whole sum/more of the house as she's been the one paying the mortgage, and this has worried me somewhat.

It seems he is stalling a little now with the correspondence that as been sent to him from my solicitors asking him to make arrangements to sign the relevant paperwork and I believe he feels he is entitled to half as I know this from previous conversations in the past.
Is this the case? Is he really entitled to anything. I do not think he thought I would be in a position to re mortgage and truly believe he was waiting for my youngest to turn 18 next year and think he would have approached the mortgage provider to pay off the mortgage himself and get me out. He has lived at his parents for the last 15 years rent free so of course as certainly saved up enough money. The original mortgage was £58,000 but worth a lot more now.
My solicitor doesn't seem worried and assured me it's all in my favour. I've struggled to keep this property with no help and just want to know where I stand.

When we briefly split up in 2012, I moved out of the renovated property and my ex-partner gave me the £15,000 back. In 2013 I moved back into the renovated property and we pay half for all household expenditure, including electric/gas, grocery shopping, school fees etc. The renovated house has now increased in value by approx £100,000. In 2014 we had another child.
In Sept 2016 we split up. I have gone on to purchase my own property albeit with a mortgage. I have asked my Ex partner to recognise that me stumping up the £15,000 (albeit this has been returned to me) and me renovating the property together with my Ex partner, should mean that I am entitled to at least a % of the profit that has been added to the property.
My Ex partner is saying I have no rights in the property and that I will not receive a penny from him in relation to the property and that if needs be he will sell the property for £1. Whilst I want to keep the situation as amicable as possible for the sake of the children. I feel like I will come out of this split very hard done by and desperately would appreciate some advice. I want to be able to set up a new home properly, so that my kids and I do not have to struggle financially.

I bought my house entirely in my name and i pay for all the mortgage. My girlfriend moved in 6 months ago and things are not working out for me and i want her to move out. The only thing her name is on is the council tax bill which i pay for anyways. We have a dog which she pays for all of him and she pays for the food bill for us and thats it. But my main worry and stress is the house. Does she have any rights or entitiled to any of my house when she moves out? Any help would be apretiated as the stress is phsically and mentally making me ill.
3x years ago me and my EX Partner split up and moved out of our shared home (joint names on mortgage) with my daughter/step daughter into a rented property. As with all break-ups there was a few initial problems but basically we split amicably for the sake of the children. I also gave more maintenance payments than I needed to do because I never wanted money to come into the equation with our children/ future relationship.
The idea was that I would sell the house pay off her debts incurred (restriction on house by mortgage lender if sold, 10k would need to be paid off) and the outstanding loan I had from our time together, then split the money that is left.
However because her circumstances have changed, she has decided that she now wants to move back into our house, spend 2 years there then sell!! I want to move out in the next 3 months and settle all debts /agreements once and for all.
I am not sure what my legal position is? she moved out 3years ago contributed nothing to any of the upkeep or refurbishments of house, more of the mortgage is paid off and there will be more money available because I have being paying the loans/debts etc etc.
I want her to have the money she is entitled to and for the sake of the children but do not want to be taken for a 'ride'

I paid all the deposit and had a deed of trust drawn up to protect this.
The deed of trust also specified that we were entitled to 50% each of any equity after my deposit providing that we both equally contribute to half the mortgage repairs and maintenance.
My bf left me after just 4 months and left me to pay all the mortgage bills repairs etc.
Now 5 years later the property has alot of equity and he wants me to sell and he wants to claim half the equity although he has only contributed to 4 months mortgage payments.

I own a house outright that I am selling. And we are thinking of buying another property, I will be putting all the profit from the house I am selling down as a deposit. This is £150,000.
We will need a small mortgage. I have tried to get a mortgage in my own name but as I only have a small wage they will not accept me. So we are thinking of doing in jointly. The mortgage will be around £50,000.
The question I have is say my partner leaves me, can she claim half the house though I have put down £150,000.

For the 1st few years my ex paid half towards mortgage. However in 2013 we split up. She stopped paying mortgage and all bills but refused to leave the house.

Every year he has reduced his maintance and I've gone along with it. He writ a letter back when he left signing property over to me saying if I sold he wasn't entitled to any profit the same if it sold and was in deficit. If work needed doing he wouldn't pay towards it. He was merely on the mortgage until a time I could get his name off.

(Its a 4bed) Is this true? I realise the £90,00 will need to be deducted from the house sell but surely I'm entitled to more than £10%? He also earns £70,000 per annum and has offered me £450 per month to support my son is this reasonable? I have no access to our joint account and I have no personal savings. Can he leave me high and dry after 20yrs marriage?

Ex & our 2 children as well as her new partner including 2 additional paying lodgers. it is a large 4 bed roomed house. Both of us work however ex earns about 20% more than myself. She has agreed that I pay no maintenance for agreeing to non sale of house until our children are 16+ . However children stop with myself in small flat 2 nights a week often longer when the need arises. I also contribute towards after school activities swimming lessons etc including school uniform and other clothing expenses.
Even though ex has now taken on mortgage payments (joint mortgage) the extra lodgers income into house and also fact new partner living there.
still amicable with ex, but get frustrated all extra income into house leaves her a small amount to find towards mortgage each month.
I am living on breadline, would contribute further if possible. worried she may try to claim back my non payment of maintenance from future sale of house when children have left school 16+ ?
House could be sold and equity shared? I would then at least have some funds for larger rental when children visit and possibility of taking them on holidays which is presently beyond my funds,
any advice appreciated
He now wants half the profit of the house, is this correct? I could not afford to pay him half and keep the house but if I sell I do not earn enough to either rent/ or buy again as I'm part time because I daughter is young. PLEASE advise, thanks in advance.
I have a joint mortgage with the ex, i moved out after 4 years however my name has remained on the morgage even though ive tried to remove it. I stopped paying the mortgage around 2 years ago. Am i entitled to half the mortage now or upto the point i stopped paying it or even moved out ? She does not agree with the valuations or the potential equity ! where do i stand?

1. Would a judge consider debt at the time of the seperation as well. I mean jiont and individual debt
2. As far as Assets that have increased or decreased in value since, are these likely to be considered at todays values or those at the time of breakup?
3. What about any assets that eithier party may have liquidated since the split? Are these considered or simply ignored if they no longer exist
I divorced 2 years ago(separated 4 years) after a 15 year marriage (no children). I reached a private arrangement with my ex whereby she had all our jointly contributed stocks and shares and I kept the house and continued with the mortgage and secured loan payments by myself. It was agreed I would have the full equity in the house in lieu of the shares she kept. Due to IVA we agreed I would take her off the mortgage and transfer to myself in 2018.
Our agreement was independently witnessed but never went to court.

I moved in with my partner 10/2012 and moved out 02/2105. She owns the property and the mortgage is in her name only. When we agreed how much I should contribute to the house it was based on 50% of the mortgage cost and 50% of all the household bills.
During my time at the property I have carried out various home improvements which have significantly increased the value of the property.
My partner took out a loan in her name and helped me buy a car. My x partner has also retained some of my possessions and refuses to give them back to me. I had previously paid a sum of money each month towards the loan but since moving out of her property I have not made any repayments.
Can I set a value for the improvements I made to her property and offset this figure against the amount she is now claiming from me. I have received a letter from a solicitor saying that because I made payments towards the loan and an amount is shown on her bank statement this is proof that a loan repayment existed. The solicitor is requesting full payment of the amount outstanding in 14 days or legal action will be taken. My partner will not discuss anything directly with me.
Any advise would be helpful.

My husband has a joint mortgage with his ex wife, they split more than 15 years ago. Nothing was ever done about the property but my husband has always made the payments, his ex wife doesn't live in the property.
